Welcome to Express Physicals.
These Terms of Use (“Terms”) govern your use of the Express Physicals website, software platform, and related services (collectively, the “Services”). By accessing or using the Services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use the Services.
1. Acceptance of Terms
By accessing and using the Services, you accept and agree to be bound by these Terms. Express Physicals reserves the right to modify or replace these Terms at any time. It is your responsibility to review these Terms periodically for changes. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.
2. Services
Express Physicals provides a software platform and related tools intended for use by doctors, medical examiners, clinics, and related professionals. The Services may include account access, workflow tools, data management features, communications, onboarding, customer support, and related business functionality.
The content and materials provided through the Services are for general informational and operational purposes only and do not constitute legal advice, compliance advice, medical advice, or other professional advice unless expressly stated otherwise.
3. Eligibility
You must be at least 18 years old to use our Services. By using the Services, you represent and warrant that you meet this eligibility requirement and, if you are using the Services on behalf of an organization, that you have authority to bind that organization to these Terms.
4. User Accounts
To access certain features of our Services, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to keep that information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us promptly of any unauthorized use of your account or any other breach of security.
5. Intellectual Property
All content and materials available through the Services, including but not limited to text, graphics, software, code, workflows, interfaces, logos, trademarks, and other content, are the intellectual property of Express Physicals or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws.
No content from the Services may be copied, reproduced, distributed, modified, republished, uploaded, posted, transmitted, or used in any way without prior written permission from Express Physicals, except as expressly permitted by these Terms.
6. Use of the Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services in any manner that violates any applicable law or regulation
- Attempt to gain unauthorized access to any portion of the Services, accounts, servers, or networks
- Interfere with or disrupt the integrity, security, or performance of the Services
- Upload, transmit, or distribute malicious code, viruses, or harmful materials
- Use the Services to infringe the rights of any third party
- Reverse engineer, decompile, copy, or exploit any portion of the platform except as permitted by law or by written agreement
7. Regulated and Sensitive Data
Express Physicals provides a provider-facing software platform. Certain regulated, confidential, or patient-related data may be processed in connection with platform use. Where applicable, such data is maintained in a separate secure server environment designed to support applicable privacy, security, and recordkeeping obligations, including HIPAA compliance and applicable FMCSA standards for data storage and security.
Your use of the Services does not relieve you of any independent legal, regulatory, professional, or contractual obligations that may apply to your organization, including obligations relating to protected health information, credentials, record retention, consent, or regulated communications.
8. Third-Party Services
The Services may integrate with or rely on third-party tools, hosting providers, payment processors, messaging vendors, analytics providers, or other external services. Express Physicals is not responsible for the availability, content, or practices of third-party services except as required by law.
Your use of third-party services may also be subject to separate terms and privacy policies provided by those third parties.
9. Termination
Express Physicals reserves the right to suspend or terminate your access to the Services, with or without notice, for any reason, including but not limited to violation of these Terms, suspected misuse of the platform, security concerns, or unlawful activity.
Upon termination, your right to use the Services will immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive.
10. Limitation of Liability
To the fullest extent permitted by law, Express Physicals, its owners, officers, employees, contractors, affiliates, licensors, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of business opportunity, loss of data, business interruption, or other intangible losses arising out of or related to:
- Your use of or inability to use the Services
- Unauthorized access to or use of our servers, systems, or stored information
- Errors, interruptions, delays, or downtime affecting the Services
- Reliance on any content, data, or materials made available through the Services
- Any act or omission of any third-party provider or integrated service
To the fullest extent permitted by law, Express Physicals’ total liability for any claim arising out of or relating to the Services shall not exceed the amount paid by you, if any, for use of the Services during the three (3) months preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Express Physicals and its owners, officers, employees, contractors, affiliates, licensors, and agents from and against any claims, demands, actions, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- Your use of the Services
- Your violation of these Terms
- Your violation of any law, regulation, or third-party right
- Your data, content, or communications submitted through the Services
- Your misuse of regulated, confidential, or patient-related information
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law principles.

14. Electronic Communications, Transactions, and Signatures
Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications from us, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email, platform notification, or through the Services, satisfy any legal requirement that such communication be in writing.
You agree to the use of electronic signatures, contracts, orders, and other records, and to electronic delivery of notices, policies, and records of transactions initiated or completed by us or through the Services.
You hereby waive any rights or requirements under any laws or regulations in any jurisdiction that require an original signature or the delivery or retention of non-electronic records, except to the extent such waiver is prohibited by law.
15. SMS Text Messaging
Consent to Receive Messages
By providing your mobile phone number to Express Physicals, you expressly consent to receive text messages from us at the number provided. These messages may include account notifications, onboarding communications, support updates, billing notices, platform alerts, security notifications, and, where legally permitted and separately authorized, promotional communications.
Consent to receive text messages is not a condition of purchase.
Message Frequency
Message frequency varies based on your account activity, support activity, billing events, and platform usage.
Opting Out
You may opt out of SMS messages at any time by replying STOP to any message. After you opt out, you may receive one final confirmation message confirming that your opt-out request has been processed.

Message and Data Rates
Message and data rates may apply depending on your mobile carrier and service plan.
Supported Carriers and Delivery
Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed. Carriers are not liable for delayed or undelivered messages.
Acceptable Use
You agree to provide a mobile number that you are authorized to use and to notify us if your number changes. You agree not to use the messaging features in violation of applicable law, including laws relating to privacy, consent, or communications.
16. Privacy
Your use of the Services is also subject to our Privacy Policy. By using the Services, you acknowledge that you have reviewed our Privacy Policy and understand how we collect, use, and disclose information.
17. California Users and Residents
If any complaint with us is not satisfactorily resolved, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N-112, Sacramento, California 95834, or by telephone at (800) 952-5210 or (916) 445-1254.
18. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
19. Entire Agreement
These Terms, together with our Privacy Policy and any other agreements or policies expressly incorporated by reference, constitute the entire agreement between you and Express Physicals regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties relating to the Services.
